Terms of Use

These Terms form a binding agreement between you and Scintilla Solutions Inc. (“Scintilla,” “we,” “us,” or “our”) governing your access to CalorieScale.ai and related services (the “Service”). By accepting these Terms or using the Service, you confirm that you have read and agree to them, the Privacy Policy, and the Health & AI Disclaimer.

Eligibility and accounts

You must be at least 16 years old and legally able to enter this agreement. You are responsible for your account, device access, and the accuracy of information you choose to provide. Do not use another person’s identity or health information without authorization.

Permitted use

You may use the Service for personal, lawful, non-commercial purposes. You must not misuse the Service, probe or bypass security, upload unlawful or malicious content, reverse engineer protected components except where law permits, interfere with other users, or use outputs to make clinical, emergency, employment, insurance, or other high-impact decisions.

Your content

You retain ownership of images and information you submit. You grant Scintilla a limited, worldwide, non-exclusive licence to host, process, reproduce, and create technical derivatives of that content only as reasonably necessary to operate, secure, support, and improve the Service, subject to the Privacy Policy. You represent that you have the rights needed to submit the content.

Service outputs

Food identification, portions, calories, nutrition values, meal-fit ratings, explanations, and alternatives are estimates that may be incomplete or wrong. Outputs depend on image quality, visible information, third-party reference data, profile inputs, and automated systems. You must use your own judgment and verify important information.

Plans, pricing, renewal, and cancellation

Analysis usage limits are disabled for all plans during the product preview. CalorieScale.ai Plus is listed at $9.99 USD per month and CalorieScale.ai Unlimited at $17.99 USD per month, but paid access will begin only when secure checkout is available. Prices exclude applicable taxes unless checkout states otherwise. Security, technical, and abuse-prevention controls continue to apply.

Paid subscriptions renew automatically each month until cancelled. You may cancel before the next renewal through the purchasing platform; access ordinarily continues through the paid term. Except where required by law or stated at purchase, fees are non-refundable and partial periods are not refunded. The payment platform may impose additional terms. We may change pricing or plan features prospectively with notice required by applicable law.

Changes, suspension, and termination

We may change, suspend, or discontinue features and may restrict access when reasonably necessary for security, legal compliance, abuse prevention, or Service integrity. You may stop using the Service and request deletion through the in-app control. Provisions intended to survive termination—including ownership, disclaimers, and liability limits—will survive.

Third-party services

The Service relies on third-party infrastructure, artificial-intelligence processing, and nutrition reference services. Their availability and processing may be governed by their own terms. Scintilla is not responsible for third-party services beyond responsibilities that cannot lawfully be excluded.

No warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Scintilla disclaims implied warranties and does not warrant uninterrupted availability, complete accuracy, fitness for a medical purpose, or that the Service will identify every food, ingredient, allergen, or risk. Nothing in these Terms limits non-waivable consumer rights.

Limitation of liability

To the maximum extent permitted by law, Scintilla and its directors, officers, employees, affiliates, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or loss arising from reliance on estimated outputs. Where liability cannot be excluded, it will be limited only to the extent legally permitted. These limits do not exclude liability that applicable law prohibits us from limiting.

Indemnity

To the extent permitted by law, you agree to indemnify Scintilla against third-party claims arising from your unlawful misuse of the Service, infringement of another person’s rights, or content you were not authorized to submit.

Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have jurisdiction, except where mandatory consumer law provides otherwise.

Changes to these Terms

We may update these Terms. Updated terms will be published in the Legal Centre and material changes will be communicated as required by law. CalorieScale.ai normally records account consent once and does not interrupt every return visit.

Privacy Policy

Scintilla Solutions Inc. is accountable for personal information processed through CalorieScale.ai. This policy explains what we collect, why we use it, when it is disclosed, and the choices available to you.

Information we collect

• Account identity supplied by the authentication platform, such as user name or email.
• Profile details you choose to provide, including height, weight, dietary preferences, goals, allergies, medical or autoimmune conditions, clinician-provided dietary instructions, sleep schedule, timezone, and consent choices.
• Optional onboarding details such as name, country, locale, birth year, preferred units, and wellness goals.
• Meal images, capture time, inferred foods and portions, confirmed ingredients, nutrition estimates, recommendations, feedback, and meal history.
• Technical and security data such as request identifiers, event timestamps, feature usage, error details, and audit events.

Purposes

We use information to provide and personalize the Service; analyze images; estimate nutrition; generate explanations; maintain history; enforce safety rules; respond to requests; secure, debug, evaluate, and improve the Service; prevent abuse; and meet legal obligations. We will not use sensitive health-related information for unrelated advertising.

Consent and lawful processing

We seek express consent before storing declared allergies or health considerations. You may decline optional health personalization and still use non-personalized features where available. You may withdraw consent and request deletion, subject to information that must be retained for legal, security, or dispute purposes.

Marketing and product-research choices are separate and optional. Declining them does not prevent use of core features. Account identity is supplied by the configured sign-in provider; CalorieScale.ai does not store user passwords.

Service providers and international processing

Authorized providers process information on our behalf, including Google Cloud for application, data, authentication, image storage, and configured image analysis. Confirmed food descriptions may be sent to a public nutrition reference service. Providers may process information outside your province or country, where it may be subject to foreign law. We require appropriate contractual and technical protections based on the service and sensitivity involved.

No sale or behavioural advertising

We do not sell personal information and do not use meal images, declared health information, or recommendations for third-party behavioural advertising. If this practice changes, we will update this policy and obtain consent where required.

Retention and deletion

We retain personal information only while reasonably necessary for the identified purposes, legal obligations, security, and dispute resolution. The in-app deletion workflow removes active profile, meal, image, feedback, and associated user records. Limited records may remain temporarily in protected backups or where retention is legally required, after which they are deleted or de-identified.

Safeguards

We use administrative, technical, and organizational safeguards appropriate to the sensitivity of the information, including access controls, governed storage, secret management, audit events, and transport protections. No system is perfectly secure, and we cannot guarantee absolute security.

Your rights

Subject to applicable law, you may request access, correction, information about use and disclosure, withdrawal of consent, or deletion. You may also challenge our privacy practices. We will verify identity before fulfilling a request and explain any lawful limitation.

Privacy incidents

We investigate suspected unauthorized access, use, or disclosure and will notify affected individuals and regulators when required by applicable law. Please report suspected privacy or security issues promptly through the official contact channel published by Scintilla Solutions Inc.

Children

The Service is not directed to children under 16, and we do not knowingly collect their personal information. A parent or guardian who believes a child submitted information should contact us for review and deletion.

Privacy Officer

Privacy inquiries and rights requests must be directed to the Privacy Officer, Scintilla Solutions Inc., using the official privacy contact and mailing address published by the company. Those contact details must be finalized before general public availability.

Health & AI Disclaimer

The Service does not provide diagnosis, treatment, prescriptions, medical clearance, emergency advice, or a substitute for a physician, registered dietitian, pharmacist, or other qualified professional. Do not delay or disregard professional care because of a CalorieScale.ai output.

Emergencies and allergies

Do not use CalorieScale.ai in an emergency. Contact local emergency services or a poison control centre as appropriate. A photograph cannot establish that allergens, cross-contact, contamination, pathogens, toxins, or hidden ingredients are absent. If you have a known or suspected allergy, rely on verified labels, preparation information, and professional advice—not this Service.

Estimation limits

Calories, weights, portions, ingredients, nutrients, preparation methods, and timing effects are estimates. Images do not show all ingredients or cooking methods, and visually similar meals can have very different nutrition. Reference data and automated matches may be wrong or incomplete.

Artificial intelligence

AI may misidentify foods, omit items, or generate an inaccurate explanation. CalorieScale.ai provides editable estimates and uses constrained rules, but those controls do not eliminate error. Outputs must not be used for medication dosing, glucose or insulin decisions, eating-disorder treatment, pregnancy care, renal or cardiac dietary treatment, or another clinical decision.

Personal responsibility

Your circumstances may not be represented by the supported profile options. Seek individualized professional advice for medical conditions, symptoms, significant dietary changes, or concerns about nutrition or disordered eating.

Ownership, Copyright & Brand

CalorieScale.ai, its software, design, branding, documentation, original content, selection and arrangement of features, and all associated intellectual-property rights are owned by or licensed to Scintilla Solutions Inc., except for user content and identified third-party materials.
